 Territorial Scope

With regards to the AFT territorial scope, the most appropriate would be to limit its area of application to the marine Arctic, within national jurisdiction, and including the high seas beyond the national jurisdiction.[186] Despite O&G activity take place within the Arctic States’ continental shelves, the nature of the activity can cause trans-border pollution beyond national jurisdiction, and will need to be addressed accordingly.

Also, it should be noted that the territorial scope of AFT may be different from the spatial scope of the protocol. Consequently, the spatial scope of the protocol addressing O&G activities in the Arctic will be adjusted in accordance with the specific O&G regulation of the protocol and may not necessarily be the same as the spatial scope of the Treaty. Such flexible interpretation of the territorial scope will allow members to enjoy various rights and obligation and few or no regulatory powers, depending on their membership status and their activity in the region.[187]
